Mesh Implant Personal Injury Claims
It may be possible for you to make a claim for personal injury compensation if you have been treated with TVT surgical mesh. “TVT” can stand for either Tension-free Vaginal Tape or Trans-Vaginal Tape.
This product has been used in the treatment of disorders such as stress urinary incontinence (SUI) and pelvic organ prolapse (POP). It has also been used in the reinforcement of vaginal walls where tissue in that area has weakened and no longer supports the organs within the pelvis.
In the United States, a flood of complaints to, among others, the Food and Drug Administration (FDA) has led to the conclusion that TVT mesh can lead to medical complications.
The FDA issued a warning in July 2011 that doctors should take heed that, in most cases, pelvic organ prolapse can be treated without a bladder sling or pelvic mesh.
Defects in the mesh may give rise to claims based in Product Liability. Some such claims have succeeded in the US and other parts of the world. Compensation may be available for injury caused by defective design of the pelvic support systems. At the moment, there are thought to be in excess of 400 Scottish claimants.
Complications have been identified to include:
- Damage to neighbouring organs
- Difficulty having sex
- Erosion of the mesh
- Hardening of the mesh
- Infection
- Pelvic pain
- Urinary problems
- Vaginal Pain
Possible factors which can be included in claims here include:
- The need to undergo additional surgery
- Emotional distress
- Impaired quality of life
- Loss of ability to have sexual relations
