When potential clients come into our High Street offices in Elgin and Forres, they are often facing a dark period in their lives.
For example: a sudden workplace accident does not just cause physical pain, it disrupts family life, interrupts income and leaves folk wondering how they will ever get back on their feet.
In around 2019, the Association of Personal Injury Lawyers (APIL) launched the “Rebuilding Shattered Lives” campaign to tackle a widespread misconception: Many people assume a personal injury claim is purely about chasing financial compensation.
But, based on our daily practice as Scottish solicitors, we know the legal framework exists for a far more compassionate core purpose:
Helping injured people rebuild their lives, restore their independence, and get prompt access to vital medical rehabilitation.
To see how this can work in real life, consider “Chris’s story“, published as part of the APIL campaign. (For clarity in understanding his accident, a “mezzanine” is an intermediate floor in a building which is partly open to the double-height ceilinged floor below, or which does not extend over the whole floorspace of the building – though the term is often used loosely for the floor above the ground floor, especially where a very high-ceilinged original ground floor has been split horizontally into two floors.)
Chris was a mezzanine installation engineer building floor structures for commercial properties.
While on a job, he stepped onto a floorboard that a colleague had laid but failed to lock into place. The board gave way like a trapdoor, sending Chris plunging to the floor below.
The fall left him with devastating, life-changing injuries: broken T11 and T12 vertebrae in his spine, ruptured nerve endings in his feet and legs, and a haematoma (a bleed on the brain) where his head struck the ground.
After leaving the hospital, Chris hit a metaphorical “brick wall”.
Four to five months passed without him receiving a single session of NHS physiotherapy or rehabilitation support.
“I went from being able to do anything for my wife and kids, to nothing… I was getting no help from the NHS, no physiotherapy or anything.”
While lengthy treatment delays leave many injured people feeling helpless, the legal system provides specific mechanisms designed to bypass public waiting lists and secure immediate private funding for physical recovery.
Relying solely on standard NHS care following a major workplace trauma can mean your recovery is more likely to stall.
NHS physiotherapy departments face overwhelming demand. Weeks or months can slip by before a doctor recognises that a patient’s rate of progress has dwindled, and several more weeks pass before an initial appointment opens up. As time ticks away, the potential effectiveness of physical therapies diminish.
To solve this problem, the insurance industry and claimant legal bodies (including APIL) created the Rehabilitation Code.
First established in 1999 and updated in 2007 and 2015, the Code prioritises medical and social recovery. It calls on solicitors to “Think Rehab” by working collaboratively with the employer’s insurer to assess and fund medical treatment as an urgent priority.
This proactive legal approach transformed Chris’s situation from months of stagnation into active, privately-funded care.
Recognising that Chris’s physical recovery had stalled after nearly five months of waiting, his family urged him to seek legal advice. Once instructed, his solicitors immediately pushed the employer’s insurer for private intervention.
The change in Chris’s physical recovery was immediate.
By avoiding public waiting lists completely, Chris was soon placed into private treatment programmess tailored to his spinal and neurological injuries. Alongside standard physiotherapy, Chris received specialised hydrotherapy, allowing him to perform low-impact exercises in warm water to safely stimulate his damaged nerves and spine. Continuous, intensive physiotherapy treated the severe nerve damage in his legs and feet, restarting his physical recovery after months of immobility.
Securing early physical care was vital to rebuilding Chris’s body, but he still had to confront a deep emotional hurdle that stops many injured workers from seeking help: the weight of self-blame.
