I had a road traffic accident which was my fault. I ran into the back of another vehicle in Elgin. I had comprehensive insurance to cover me – or so I thought. Unfortunately, my insurers decided that I was ‘commuting’ at the time of my accident and that I did not have insurance cover for using my car in that way. I disagreed with my insurers that I had been commuting at the time but they wouldn’t listen to me. After many months, it got to the point where my insurers said I owed them over £14,000 to cover the cost of the claim by the other vehicle driver (including their personal injury compensation). On top of that, my own claim for the damage to my vehicle was rejected by my insurers and I had to find the money to pay for repairs myself (about £2,500). I had never been in such a situation before. Communication with my insurers was very difficult. I felt I was told different things by them on many occasions. It was all very stressful and worrying. I got in touch with Grigor & Young and things improved from there. For a start, I no longer needed to be in direct contact with the insurance company, which was a relief. Finally, there was someone to help me understand what was happening. G&Y were very professional and approachable. They were always quick at responding to emails and to any questions that I had. They were very patient, as it took a long time with the insurers. In fact, G&Y had to help me make a complaint to the Insurance Ombudsman. That prompted the insurers to carry out a full investigation themselves, at last. The outcome was that the insurers apologised for the poor customer service I had received. They accepted that, on the numerous occasions when I phoned them: they had misadvised me; they had cut the line on me multiple times, with no call backs; and they had transferred me to incorrect departments. It seems that they didn’t just provide me with a poor service, they did it deliberately. They actually admitted these things in writing. In addition to this, they noted that I had requested for a Form of Consent and Indemnity to be sent to me via post as I did not have access to a printer – however, this was never sent to me. The upshot was that they completely reversed their position. They agreed to cover 100% of the claim made against me by the third party driver. They also compensated me for my own out-of-pocket costs in repairing my own vehicle and paid an amount to reflect the stress and inconvenience they had caused me. I would 100% recommend Grigor & Young for the service I received, from the moment I phoned them to the moment it ended. I felt valued and I felt like they actually cared about the situation and how I had been treated by the insurance company. It was not just about “winning my case”. It was about the fact that this should never have happened at all and trying to ensure this would not happen to anyone else in future.

I worked in a care home for the elderly in Moray, as a care assistant. I fell and broke my hip. I was injured when I tripped over the electrical flex cord of a piece of equipment which was in the room of one of the residents. There was an extension cable in use – lying on the floor – at the time, though this was against the home’s health and safety policy. Liability for my accident was denied by my employers because they claimed that it was me who had moved the fan in question to its position at the time of the accident – and so I ought to have known of the positioning of the electrical cord and seen it. I did not agree that the lead was positioned due to anything I had done or not done immediately beforehand. Other staff would have been in the room between the time of my last visit and the time of the accident. Nevertheless, I was pessimistic that I would be due any compensation and my employers’ attitude meant that, at least to some extent, I was putting the blame for what happened onto myself. I didn’t think I could claim successfully and, in any case, I was worried about possibly having to go to court if I did claim. On consulting Grigor & Young, Peter Brash explained why he thought there was every chance my claim would succeed. He remained of that view even when liability was denied. We had to raise a court action but the home’s insurers then made a settlement offer. We refused their first offer and they then increased their offer to an acceptable level. I would like to thank Grigor & Young for all their help with my claim. I was injured in a supermarket in Elgin when I tripped on a bollard near the entrance to the store. I consulted Grigor & Young in connection with a possible medical negligence claim for my elderly parent, who lacked legal capacity. After getting a guardianship appointment through Elgin Sheriff Court with the help of Grigor & Young, it proved to be possible to make a successful compensation claim. “I had been getting a new kitchen installed through a nationwide home improvement store in Elgin, but there were problems with it. I went into the store to speak to one of the managers but no one was available at the time. As I was leaving the store, I tripped on the low end of a sun lounger which had been displayed at the end of an aisle. I fell and broke my kneecap. “I was driving on the A95, heading north towards Aberlour. I was suddenly confronted with an oncoming vehicle on my side of the road. I could only avoid a head-on collision by braking and swerving onto the verge. I managed to manoeuvre back onto the road beyond the oncoming vehicle but I had lost control and my car rolled several times. It came to rest the right way up, still on the roadway. I did not realise immediately that the injuries I had suffered included a broken collarbone and a broken wrist. The police and an ambulance attended. The third party was a foreign driver. Due to a mix-up between the police officers who attended the scene, they did not get the details of the other driver. Subsequently, when I was first considering whether I should make a personal injury claim for compensation, I was doubtful it would be possible to do so, given that the other driver was untraced and from outside the UK. When I got in touch with Peter at Grigor & Young, however, he explained that it should be possible me a claim through the Motor Insurers Bureau’s Untraced Drivers’ Agreement, if necessary. It turned out that, indeed, the third party could not be traced, so I did make a claim via the untraced drivers’ agreement. I liked the way I was kept informed at every stage. Peter gave me comprehensive help in filling out the MIB’s claim form. I did not have to pay anything for fees or outlays at any stage. It was possible to agree a level of compensation with the MIB and I received that amount in full, without any deductions for legal costs or anything else. “I was injured in two separate accidents at work – about three months apart – while working at a building site in Lossiemouth. The first time, I got a bad cut on my hand, which needed stitches and left a scar; the second time, I was operating machinery which overturned and I hurt my neck and back. “I was injured in a road traffic accident in Elgin. I was driving on Edgar Road in New Elgin and turning into Wards Road at its T-junction with Edgar Road. A taxi waiting at the junction pulled out, without warning, striking my vehicle on the driver’s door. I had whiplash injuries. I was quite unwell following the accident and the repercussions lasted for many months. It didn’t help that I had previously been injured in a car accident about 20 years ago. Having said that, at first, I did not think any claim would be worth sufficient value to make it worthwhile because, even before the accident, I was not working any more. I discussed it with my friends and they all said it was not worth claiming for. In the end, the biggest motivating factor for me getting legal advice was that I wanted justice and that even though it may not have been a significant amount of cash that was at stake. I kept seeing taxis from the firm that caused my injuries every time I was out and about, which was a constant reminder of the accident and my ongoing problems. All I had to do was go in to see Peter at Grigor & Young and give him details at a meeting, including photos I had taken at the scene of the accident. These showed the positions of the vehicles after the collision and the damage to them. There happened to be a police officer in a car in the queue behind the third party vehicle, which helped for witness evidence. I feel Grigor & Young made life easy for me, after that. I was kept informed throughout the claim and everything was clear and concise. Peter rang me up and “pushed me” to progress things when necessary – he kept me on the straight and narrow, as far as moving things on was concerned. Things did not run entirely smoothly, in the sense that we ended up having to raise an action in Elgin Sheriff Court. This was because, first of all, liability was denied. Then the insurers’ claims handlers made a poor offer in settlement of the claim. Then, to make matters worse, the third party insurers went bust. Peter reassured me and gave me the confidence to continue with the claim even after that happened. This is not the first personal injury claim I have had to make. My previous road accident ended up as compensation claim in the Court of Session, through other solicitors. I didn’t feel that I got any less level of service from Grigor & Young with this claim than I got in the previous – more serious – case. I would recommend anyone to go and see Peter Brash about a possible personal injury claim. I would like to thank Peter for all his hard work and for getting me a good outcome. “I was injured in a road traffic accident in Moray. I was a front seat passenger in a car driven by my partner. It was a single vehicle accident. The car went off the road due to icy conditions. I had multiple injuries, including a fracture which required an operation to insert metal plates and pins. It took me a while to go ahead with making a claim. In the first place, it never occurred to me that I could claim. I had heard advertisements on the radio about “no win-no fee” claims but I think they just washed over me. Then, when a work colleague spoke to me about the fact I might be able to make a claim for compensation for my injuries, I was unsure whether it would work because the person I would be claiming against was my partner (i.e. “a relative”). I actually wondered whether my injuries were serious enough because my injuries were not obviously visible and I wondered whether it would be believed that I had suffered them in an accident. In any event, at least initially, I thought I would make a full recovery. The impact of the injury made every day things take longer and I did not have time to think about “extra” things like making a claim. Because I live with my partner, to some extent, I was playing down the extent of the injury because I didn’t want to make my partner feel more guilt than was already the case. I was not in paid work at the time of the accident, so I did not lose any wages – another thing which made me think I did not have any “losses” to claim back. I was worried that my partner would be in trouble if I made a claim or experience an increase in insurance premiums. I was also worried about the prospect of possibly having to go to court. The potential cost to me was a concern and whether any initial quote for costs might suddenly escalate as, once I had set off on this path of making a claim, everything would be “out of my control”. In fact, what I found was that, when I spoke to my partner, I was reassured that my partner would feel better if I got some compensation for my injuries and losses. It was also reassuring to know that a full medical investigation would be carried out as part of the claims process, so I would be able to prove my injuries from the accident without difficulty and have a much better understanding of my ongoing problems and prognosis. I was reassured by my solicitor that, while it would be a pain for them if I suddenly decided to drop the claim halfway through, I remained in control of the claim. I felt I could trust my solicitor to act in my best interests at all times.”
